Thread: Where do I whine officially ??? | Forum: Poser - OFFICIAL
Crescent: home made yuck puddle - I must official plead "No comment" but my co-workers are wondering why there's tea all over my monitor ... Probably for the same reason there's tea all over mine...not to mention up my nose! BWWWAAAAAHAHAHAHA!!!
Thread: Until they decide on a color scheme, this may help | Forum: Poser - OFFICIAL
ROFLMAO...Pengy, when I first saw your post I thought you were going to try to convince all of us to put Linux as our "primary OS" :^p Marco...your design ROCKS! Your color scheme is much preferred. My preference is to use the new logo's but put things back the way the were...let us pick our own color schemes!!!

Thread: Confused about Supreme Court ruling with CGI | Forum: Poser - OFFICIAL
HeWhoWatches: "I'm not a lawyer (thank whatever powers may or may not exist for small mercies) but I think this is what's called a shrinkwrap contract, and is totally without force in most places (with California being an exception). Once you've purchased the product, it's yours. They can't dictate to you what you can and can't do with it."
When one is not a lawyer, one must be careful making blanket statements and generalizations regarding legal issues. There are young people here and people not familiar with the law that can be misled by incorrect advice that could involve them in costly litigation.
In the United States a "shrinkwrap license" is considered a contract, it is generally terms in the license that are contrary to existing state or federal laws that are unenforcable. The license DAZ uses would be more commonly called a "clickwrap license", the term derived from the requirement to "click" an "I Agree" button after reading the license which is displayed on the screen by the installation program. Such licenses have been found to be enforcable by most courts including the Seventh Circuit Court. When in doubt about your rights vs the license...it's safest to consult a lawyer.
Thread: !!!Anna-Mare Goddard Responce!!! | Forum: Poser - OFFICIAL
Taking Toprol XL keeps my blood pressure just fine sweets! Yes, I have posted there, but I wouldn't go so far as to say I love to post in it...come to think of it I haven't posted much there lately, many of the posts have been a bit "vexatious" for my taste. Now don't get me wrong, PP is a great site and I enjoy it very much...but I believe I detected a slight note of condescendence in post 37 ;]
Hmmmm...this forum is supposedly for learning? That's funny...I was under the impression this forum was for discussions related to Poser, and I think it's safe to assume that DAZ's "digital clone" relates to Poser.
But...snicker away...and mind the sarcasm ;p

Mehndi: *Really people, I've never read such a silly thread in all my born days. Those who do not want the product need not buy it.
I'm not sure what is funniest, posing nude then having the unmitigated gall to worry over what folks are going to do with your 3d body, or getting all heated up over whether Daz has made a business mistake or not.*
And those that don't want the product won't by it Mehndi...along with those that find the EULA for the product too restrictive. Nobody has been concerned over whether or not DAZ made a business mistake Mehndi! If you think it's so silly for people to discuss this, perhaps you should make that same comment in every thread in the Chicken Coop over at Poser Pros! I've seen much sillier and outrageous discussions there.
Thread: !!!Anna-Mare Goddard Responce!!! | Forum: Poser - OFFICIAL
The point is I can spend 40 bucks on DSI's digital clone of Dina Vannoni and use her right out of the box for anything I want to, naughty, nice, or commercial and not have to worry about EULA's, negotiations, or permissions.
Read the EULA again! The EULA states you can't:
"(3) sell any portion of rendered output that contains any portion of the 3-D Model(s) without prior written consent of Anna-Marie Goddard, her attorney(s), or other legal business representation."
Now, that does not say you can use the mesh in commercial products if "you play with her face a bit so it's not recognizable"...it says you can't sell any portion of an image (rendered output) that used that mesh (any portion of the 3-D Model(s)) to create the image. That's the only way you can interpret that clause.
I hope what DAZ get's out of this "fuss" is that the next time the decide to do a realistic human mesh, they'll do it with someone that doesn't need to restrict the EULA except to protect the mesh from distribution.
Thread: !!!Anna-Mare Goddard Responce!!! | Forum: Poser - OFFICIAL
Well, see now, I'm not concerned about whether or not the mesh and texture is going to be used "respectfully" or not...in fact I could care less. For me at least, it boils down to not spending (US)40 dollars for a morph and texture that I don't have complete license to use out of the box for anything I want without having to negotiate with anyone or worry about whether someone thinks I defamed or damaged them.
Thread: Racial Slur | Forum: Poser - OFFICIAL
Well Axe, you're certainly entitled to your opinion...no matter how misguided it is. But you are not Replicant, and even though you want to make excuses for him...the fact remains that he did search for nakamuran, and that information showed that nakamuran was not likely a troll. The only conclusion that Replicant's statements can lead to...are that he feels that without a gallery, one is not a contributing member of this site; and therefore, not entitled to complain or have an opinion. There are many members that would take extreme exception to that kind of disregard.
Thread: Racial Slur | Forum: Poser - OFFICIAL
Axe_Gaijin: *"He is not claiming that a lack of contribution is actually a reason to regard to opinion of someone lower then an others.
He's merly voicing his suspicion that Mr. Nakamura is in fact a Troll tring to stir up a hornets nest. (looks like he succceeded)."*
Get real! It's obvious from the number of times he made the statements, and made comparisons of the number of contributions by xadmax and nakamuram that's exactly what Replicant meant...A simple check of the member list shows nakamuram has been a member for over a year, lists a Real Name that is unlikely to be a fake, and a search shows he's made a moderate number of posts in various forums since he joined...not the behavior of a Troll. Replicant had to have checked that, otherwise he would not have know nakamuram had been a member for a year and had no gallery or free stuff contributions.
Replicant: "The touchy Mr Nakamura has contributed nothing in the year he's been here. Zip. Nada. Not even a pixel on a page"
Hmmm...maybe you were reading the wrong post Axe, try reading posts 16 and 23! Replicant clearly states:
"Xadmax has made several contributions to the community while nakamuram doesn't seem to have made any."
It's pretty clear that Replicant is saying that nakamuram has no right to complain or state an opinion because of a "lack" of contributions to the community. You gotta be sure you understand what's being stated Axe, otherwise could end up appearing foolish.
;^P
Thread: Racial Slur | Forum: Poser - OFFICIAL
Replicant: "The touchy Mr Nakamura has contributed nothing in the year he's been here. Zip. Nada. Not even a pixel on a page."
And this is relevant...how?
Replicant: "If you refer to the point I made before that one nukem I was trying to point out that Xadmax has made several contributions to the community while nakamuram doesn't seem to have made any."
And this has relevance to a member feeling offended...how?
Replicant: "How come its always non-contributing members who post these wasp-nest-stirring threads?"
Replicant has a gallery, nakamuram doesn't, neither have contributed freestuff...they both have made posts in multiple forums...that hardly makes Replicant more of a contributor than nakamuram! Merely being a member of this site gives one all the license required to have an opinion and express it!
Without hearing from xadmax2, one might assume that his use of the word was an unfortunate choice and not meant to be offensive. It may be, for any number of reasons, that xadmax2 doesn't have any idea that the word may have a negative racial context to it and used it innocently. That is by no means meant to minimize the impact of the word as a slur, or the offensiveness it may have to some people. Certainly, a more appropriate way to have handled this would have been for nakamuram to have contacted a Mod/Admin or contacted xadmax2 directly with his concerns.

Hmmm...I don't have Vicky 3...but I have to say Kevin, after reading your idea on how to handle this...the word "genius" comes to mind. :^)

Lorraine: "anyways...who got angry when the Poser forum was created specially for the poser user?"
Ummm...actually, no one because this site was originally created for the poser user (in fact it was called The Poser Forum!)...lol!
I agree with Kendra and Crescent, there is already a genre for religious/spiritual images...the forums revolve around products and technical matters.
