Subject: Can Lightsabres be put on download for commercial use?

karl.garnham1 ( ) posted Wed, 21 November 2012 at 1:28 PM · edited Tue, 05 November 2024 at 6:07 PM

Hi Freestuff Forum

I was wanting to ask I am going to make a lightsaber without the blade and put it on the freestuff forum but I want to make sure as Lucas owns Star Wars its ok to put it on for Commercial Use as I really don't understand what classes as Commercial or not commercial I will make the Light Sabre in Bryce 7 Pro which has commercial use on it but I really need to be sure its ok to do so. The Lightsabre itself will be one of a kind.

Cheers

Karl

actually disney owns starwars and lucas is their 2nd largest share-holder (after steve jobs' widow).  to learn more about copyright/trade-dress policies, try a search of marketplace, freestuff or sharecg to see if any light-sabres are already on offer.

Thanks Miss Nancy

it says unrestricted use on Sharecg so I am guessing it is for commercial use on Renderosity though all the sabers are on non commercial maybe I will put it on non commercial and do some research first. Cheers

Karl

Ps. Yeah Disney now owns Star Wars But I will always think of Lucas owning it as he was the creator of it.

Disney doesn't like people making money off of their ideas/animated characters/movies unless someone gives them money first.

Right thanks for the info LaurieA.

It will go on Personal Use then as I am never going to pay Disney the amount of times I have had to suffer Rubbish like Beauty and the Beast, The Lion King, The Little Mermaid and an assault of the evil other annoying rubbish(My opinion just my opinion I find Ducktails funny if you like those there is nothing wrong with that). Is seriously not cool They made me sit through that garbage at work until I told them where to put it).

So it will go on for Personal use only.

Just remember that Lucas Arts does have a trademark on the 'lightsabre' {and they are VERY protective} so if you upload to Renderosity's freestuff, you will need to choose a different name for your item...maybe 'lightsword' or 'sword of light' or something similar.

If it resembles the sabre in Star Wars, you can't have the identical name here.

Your best bet in the future is to visit the US Copyright/Trademark site:

Thanks Jumpstartme2

You make a fair point I will not call it a lightsaber I will call it Enigma Sword or something like that. I just made because I thought someone would have a use for it I don't ever use these models myself so I tell you what I leave it to you if it is going to be a problem I don't want to upload these sort of items and you are the Admin of this site so I respect what you have to say and manage and its a huge site. Calling it something may just be a way of a clever way around it and as you said Disney and Lucas Arts are not fools so I can leave it and if someone else whats something different made that doesn't fall under a company name then I would be more than happy to make it.

Cheers

Karl

No no, it is fine to call it something else..the only thing Lucas would toss a fit about is if it were named the same thing and got people confused. Naming it something else protects you the creator so it is fine to post it :)

As far as I know (and I'm not a copyright attorney, only someone who's been making Poser models for over 10 years), Lucas seems to be fine with fan-arts stuff as long as no one is selling it or making a profit from it.

Whether Disney continues this policy remains to be seen. 😉

Thanks VanishingPoint

I did recently upload it as Enigma's 5 Bladed scimata I am not seeking to get Money
I do my work because I enjoy it. I doubt Disney will carry this on though But thanks for the info. You have been working in Poser for over 10 Years you must be a professional at it now I have been working in Bryce for 6 Years.

Cheers
