Here is a photo I liked.
Feeeeeg had posted a comment and they just join on 11/11/2011 and is worried about takeing photos of people
this is privite land here yes but this is the law also and it the law in New York as I looked it up and it the law all over USA as far as I know
If the private property is open to the public, such as retail stores, private stadiums or tourist areas, filming may be allowed unless there are signs posted expressly forbidding videotaping or photography
There was no signs and every one was takeing photos that had cameras and videos too.
This is the answer I give Feeeeg as i can not IM the person as they have no images up . I put in the link to where I find the laws

thank you for you input and remember I not selling the photo and if what you saying then it would put the Hollywood movie makeing out of that state which the state of New York will not do as they need all the money they can get.
Also this is in Texas that do not have that law in public which new York do not have also. so please read and see it on Private Property and that goes every where in the USA. there is places in Public Places that is unlawful to take like bedrooms, bathrooms, changing rooms, locker rooms, hotel rooms. so please do your home work as I did . thank you very much.
If some one know Feeeeg please let him know I posted a respond to his comment .
I just like to clear things up and I like to know the laws too. and now we know. So get your cameras and take the photos.

I could not copy Feeeeg comment here as it would be wrong as the TOS on this site say so. but this is the image they worry about "just walking and drinking a light beer, barbarian" thank you oh if some one knows Feeeeg please tell the person I did comment on the comment they put down and the law site may put some light on what they think the law say and what the law is really about

I couldn´t all understand about legal photography or not, I have to study it later. We have the same discussion here in Germany. Private ground or not? Showing people or not? It is forbidden to portrait somebody and public this pic without her or his permission, so all my portraits of people in my gallery are illegal in Germany, but not in your country. My problem in Germany: Many people believe they have some rights to forbit something, but they aren' t right. I often had discussions with people (with an upright tendency) on the streets while I am taking pictures in Berlin. Don`t be worry, Jocko! Fine picture and a very fine series! I detected it some minutes ago. I will come back soon for a longer look!

You are so right Jock about privacy laws. Although on private land, this is a public venue and people appearing in public, especially at this type of event, have to expect to be seen and photographed. If the photos were to be used for marketing, promotions or sales then model releases would be needed. Anyway, all that aside, this is a great shot. I got one of her and her companion but I was not as close and the details in her outfit were not as sharp. Wonderful!

Great photo! You're right that the law is pretty favorable towards this. Also, as a veteran of renaissance festivals (and a maker of exotic garb, myself) I've found that nearly all of the people who go to these, especially those who costume up, welcome people taking their pictures. I always take it as a high compliment if someone considers my garb worth photographing. It's a huge part of the event for most of them, and I find that the people in costume are a huge part of the draw for everyone else. Back to this fine lady, she's got an impressive gown, and those feathers are magnificent. Wonderful shot.

Ahh. Okay. I went back and read the original comment by Feeeeg, and indeed, he is mistaken. You are 100% correct. I've researched the laws carefully (as we all should, if we're going to be out with a camera) and even carry a copy with me in my camera bag, just in case I'm stopped by someone who thinks I'm doing something wrong. The key phrase is "reasonable expectation of privacy." If you're walking down the street in NYC, or anywhere else for that matter, you have NO reasonable expectation of privacy. Even if you're standing in your front yard watering the flowers, and I can see you from the street, you don't have a reasonable expectation of privacy. I can take your picture and post it on the internet and be within the law. If you're in your front yard watering the flowers and you have a big fence and I take a picture of you through a crack in the fence, I'm totally out of line. That fence gives you a reasonable expectation of privacy. Not every security guard and mall cop (or full-on police officer) knows every law. We should be aware of the laws surrounding photography, since we're the photographers, and we should be able to explain and produce a copy of the law in a clear and calm manner if asked. Random security guards cannot tell you you can't take pictures, and they can't take your camera. Not even a duly sworn officer of the law can confiscate your camera, or the card, or anything else, without a warrant. If they insist upon taking your camera, or the card, that's called theft and we should know that and be able to speak confidently on the subject. Unless it's posted somewhere that you can't take pictures, they can't even force you to delete an image. Sorry ... this is one of my pet soapboxes, and it was too much of a temptation to agree with you at full volume! LOL! Did I remember to tell you I like the picture? :)

A wonderful photo of this fine looking lady! Love her dress and attitude! Very fine capture Jocko! You have really shed some light on this subject of people in photos! I had no idea as to what was legal to post or not, so have never tried. But yours and the other comments seems to have cleared up this subject. Thanks for the information! I greatly appreciate it!

Have read all the comments on your first post where this came up and all comments above. Different countries have different laws but thank goodness we have laws that in this case protect photographers and their rights too. MrsLubner, NefariousDrO and auntietk are 100% right. Love your picture of this lady complete with peacock feathers...SHE KNOWS HER PICTURE WILL BE TAKEN OR SHE WOULDN'T BE THERE! :)

As proud as a peacock - or, in this case, a peahen! I think the only really sensitive area over here is photographing children and displaying images of them on the net or elsewhere. If you want, for example, to put an image of a child in the local church magazine then you have to have written permission from the parent.
