I sent this to him privately, but I think it's probably good advice for many:
Jon,
I am not a lawyer, but have experience in business working with lawyers. If you want to resolve this the quickest, without hefty lawyers fees, I recommend the following approach:
First, if you have a lawyer involved, ask if they'll take the case on contingency. Probably not, but it never hurts to ask. If so, then hire him and take his advice, if not proceed as follows. It sounds like you have the wrong lawyer helping you at this stage as he's gotten nothing done in nine months. If you're going to use a lawyer, you really need a lawyer who can get things done.
If you want to minimize how much you spend on a lawyer:
Do not talk directly with their lawyers. Call their offices on Monday and speak to their CEO or CFO. First rule: Business people talk to business people, lawyers talk to lawyers.
Try to negotiate a settlement which works for you. I don't think at this stage you can prove damages unless you have a client who has fired you based upon the stockart accusations, but I'm not sure about this (IANAL).
My hunch is stockart.com is already aware NOW of this situation-- as it's all over the web. Very bad exposure for them as they depend on communications designers and artists for their very livlihood. I suspect they want to settle this quickly. Before contacting them, create a list of what it is you want from them. Here's a start:
Public letter of apology to you and your clients
Remove your artwork from their site
Provide you a hold harmless agreement
If they agree over the phone to some basic terms, follow it up with a non-binding terms letter (or email). This way you document the negotiation and not have to spend your own legal fees on the negotiation. If you need help with negotiations, talk with your lawyer, or other saavy business men.
Second Rule: Business people negotiate settlements, lawyers paper them. Only after you and they are agreed in the letter, then turn it over to the lawyers. If you're trying to save money, have their lawyers draw up the initial agreement, then have your lawyer go over it.
If there is anything in the legal agreement which was not in your non-binding terms letter, explain to their CEO (or whomever you negotiated with) you have existing terms in place, and it is not the lawyers place to negotiate further. It's negotiating in bad faith on their part and is not a professional way to conduct business. The negotiations are already finished. Do not sign unless they stick to your original agreed upon terms.
You've done a good job putting the pressure on them. Good luck!

Thread: How do you create this kind of sky? | Forum: Vue
By the way, if anyone wants more information on standard atmosphere skys, you may wish to check out my free Fog and Haze tutorial at C3D. It goes over in detail all the settings for both Standard and Volumetric sky fog and haze.
Trying to recreate the above in a spectral sky would be most difficult. Bruno, you up to it?

Charles,
Thanks for posting. Most interesting case. My guess it will be resolved very soon as stockart.com can't afford this sort of pressure.

Sorry seeing this so late. In anycase, yes you need to make sure your room is 'water tight' and has a wall thickness. Also, consider removing the ground plane if you see leaking around the baseboards and replace it with a regular plane. You may have to move it off the baseline of the floor as well. HTH.

Quote - Dear chippwalters, you REALLY brightend my day! After the recent events in the financial world, there is still somebody on this planet who believes that firms official finanancial information bear the slightest connect with reality....
e-on is a private company and has no public 'official financial information.' Hopefully this doesn't 'un-brightend' your day.

It's most easy to rip your above arguments to threads, one by one. For instance, let's take number 1:
Quote - Infinite/xStream is now exaclty in the same price range of real professional products, without having their functionalities making people wonder: well, if it costs like Modo 401, why should I not get Modo instead?
It's clearly because Modo and Infinite/xStream are two completely different programs with different features. Modo is mostly a modeler with rendering only lately added. It is not focussed on landscapes. Your comment makes as much sense as "Why do I need Microsoft Word when I already have Photoshop?"
Quote - Is anybody here fanboy enough to assert that the above mentioned consequences are good for the future of Vue and E-On?
Without having e-on's balance sheet (private company, private balance sheet) in front of me, I cannot assert one way or another. How do you know they are not actually doing better than ever? The fact is, you don't-- you're just making a very stupid and ill-informed comment. I'm sure there are plenty of informed folks at e-on who have carefully thought through these issues and are doing their best to add value to their product line and their company.
So sorry you've come out of your self-imposed exile-- perhaps there's hope of another one? Please keep us informed.

CobraEye,
I typically ignore chronic haters like you, but since you mention my name, I thought I'd search through your posts to hopefully find any positive or helpful comments and see if you had provided value to this community in the past.
Of course, there is nothing but the standard spit and venom of your namesake. One only needs look back this last month or so to find the answer:
Quote -
"If you can't see this then there is none as blind as he who won't see."
and
"People have been complaining about the grain, noise, and flicker of vue for e-ons! There is no hope."
and
"Between the Upgrade Problems & the Pricing Problems, I start to wonder how many people work at e-on... ?"
and
"It's more like what limits am I not talking about. There are too many to list. I feel that vue is old software doing it the old software way."
and
"The people at e-on are nuts for all these crippled versions of vue. What waste of time. I think the entire price of this upgrade is wrong. But let's face it... Vue has really reached it's limits and it's time is short."
and
"VUE HAS FAILED ME MANY TIMES."
It's an interesting read to read through your posts of the last 90 days. Not one positive comment.
It's certainly not necessary to be a Vue fan to participate in this forum. For example, ArtPearl has on occasion disagreed with e-on's positions in a positive and productive way in the past, which has brought about clarity to many of us here. (I am a fan of her art and her helpful attitude, while speaking her mind.)
That said, it's clear you are a troll, only looking to talk down e-on and Vue. Please go away.

No surprise-- I like the idea of T-packs. They make it easier for someone to get started creating scenes. I'm particularly fond of the Sci-Fi one-- though I didn't work on it (kinda wish I did!). And nope, they're not directed at folks who visit here regularly, as they will be marketed to different channels than xStream,Infinite and Complete. As new product offerings, they of course are mentioned (featured) in e-on's newsletter.
I just started working with a friend of mine who just got Complete. While he knows quite a bit about 3D, it's clear Complete has it's learning curve and challenges for newbies. It's also clear to me how much I take for granted the Vue interface. Nice to see the program from a fresh perspective. My friend's enthusiasm and overall happiness with Vue is refreshing.
