Harm is irrelevant. You are asking someone else to break the law, potentially risking federal prosecution for criminal violation of copyright under the DMCA. Copyright law does not include monetary gain as a factor for legality or illegality. In short, it doesn't matter if the item is free or paid for, the exact same rules apply

ChuckEvans ( ) posted Mon, 06 December 2004 at 7:04 PM

I don't think it comes down to monetary, Sarte. I think, since the death of the creator, it's up to the new "owners" to decide about distribution. They may have their own reasons to not allowing distribution. Just my thoughts. Good luck in getting the file.

Sarte ( ) posted Mon, 06 December 2004 at 7:06 PM · edited Mon, 06 December 2004 at 7:14 PM

Well, the new owners have yet to provide me with a way to get in touch with them, so there's no telling what the status of said item is. You can lock this topic if you want, and add your snide comments on the last post, but it still doesn't make you right in either a legal or ethical sense. I guess you just want to have your cake and eat it too.

Then the status is that no distribution is allowed.

Well, if you are referring to me, who sees your side of the conversation but also sees other possible sides to the situation... I don't lock threads (smile), 'cause I can't.

I think it's a general message to mods who might be reading this all after the fact. That is to say any one of the following: Forum Moderators: Shoshanna, SndCastie Coordinators: LadyTieryn, karen1573, nemirc, ryuslilangel Everyone else is simply trying to help, I believe.

No one's tried to help me get in contact with the admins of that site that I posted a link to. Nobody explained to me what to do about the login system. I don't call that help.

Well, since, from what I can see, the system is merely an archive, I don't think that's possible. Although you might have missed it in a separate thread, I also attempted to contact them regarding the files. After four months, I stopped. There is a point of diminishing returns, and as there are excessively few regulars here capable of reading japanese, I seriously doubt you will have any greater success than I did.

No one's tried to help me get in contact with the admins of that site that I posted a link to. Nobody explained to me what to do about the login system. I don't call that help. what methods have you tried so far? have you tried contacting artist he has worked with? have you tried e-mailing his hotmail account? Have you tried contacting the domain of the web page and asking them to pass a message to the person holding that subdomain. They are unlikely to give you their info, but they may pass your info to them.

its not perfict. ok. step by step go to babelfish put http://infoseek.co.jp/ in and set to translate from Japanese to english when the translated page comes up in the upper right is a link called "help". click it. on this page scroll all the way down to the bottom. on the right side there is a colum labled "information" click the last link "Opinion question to information seeking" on this page on the right under "About member service" click the last link "In addition member service" this will show you a page with a form at the bottom to fill out. ask them to send your contact information and a short note to the owner of http://cyobitlab.hp.infoseek.co.jp/ or however you want to word it. once you fill it in "submit" is the button on the bottom on the left. I think you can submit it thru babelfish, but you may have to go to http://www.infoseek.co.jp/Help?pg=toiawase_members.html and fill in the info with the babel fish translation open for reference. there is not promise that this will make contact but it is worth a try. also try contacting some of the artist he has worked with. i seem to recall there are some links in the readmes to other artist sights.

I have gone into my archive and pulled the ReadMe from the Jin Roh armour in question. I append the text in entirety here: POSER4---Original Character---<[Jin rou] Special Armor Force Protect-gear > ============================================================ The character of "Protect gear" is copyrighted 2001 by Taruru. All Rights Reserved. This may be used only in your non commercial, personal artwork. *** A method commentary to use *** 1.Thaw this zip file. 2.Put it on the fixed position with keeping the directory structure of the file group that it was thawed. Wherever it is put, it doesn't care about this Pz3 file. 3.Start Poser4, and call Pz3file. 4.Open the pose of the library, and register the pose of the initial condition as a default pose. *** Attention in use *** 1.Though a head is locked under the initial condition, this is a thing by the specifications of the mask and the air pipe. Move it on every the neck when you want to move a head. And, do an angle to move by 10 times. It is disgraceful if it doesn't go. 2.The armor (shoulder_armor_L shoulder_pad_L, shoulder_armor_R shoulder_pad_R) of the shoulder is to adjust it to the option with the dial and so on when you interfere when you do raising and lowering of the arm. *** Supplement *** This character is the thing which should be called a beta-version. It is waiting for the opinion of first of all introducing it to the public and let's ask an opinion and sensation and the advice. Moreover, it is waiting for contribution as well to say, texture was made and a neat pose collection was made. Don't bully it very much because it is the first character production... Taruru mk_taruru@hotmail.com http://www.jet.ne.jp/~m-jacky/index.html Animation movie [Jin rou] copyright 1999. mamoru oshii Bandai-visual/Production-I.G Here then is the key statement, "The character of "Protect gear" is copyrighted 2001 by Taruru. All Rights Reserved. This may be used only in your non commercial, personal artwork." I take that to mean Taruru-san intended to keep control over his artwork. Taruru-san, like many of the Japanese masters was a craftsman of great generosity. However, sadly many of them have been taken advantage of, and have removed there offerings to the detriment of all. To show how serious Taruru-san was about copyright, you will note that at the end of his readme he gives credit to Mamoru Oshii and his studio for the creation of the original concept and design of the Jin Roh armor. I am sorry Sarte that I cannot help to facilitate your obtaining the Jin Roh armor. I cannot help you to contact the holder of the copyright on this or any other of Taruru-san's artwork. He is beyond us now. I would suggest to all that his former site will not always be there. Someone is being generous and maintaining his site (probably in honor of him) so that his work might still be enjoyed. As with all good things in Poserdom, it will not last. Be thankful for what you have. Take waht is freely offered and thank those who offer it. There is nothing that says that they must. Sarte- there are many good, generous and helpful people here. Ask nicely and you will be amazed what they WILL do for you. Behave as if you are owed something from this community, and see how fast it gets cold, dark and lonely. I have been far too long winded here, and will not post to this thread again.

All of his files say that. Scopedog gives credit to the creator of Armored Trooper VOTOMS, yet somebody put it up on that website. Zip a copy of the file together and please send it to the webmasters if at all possible.

Until, and unless, one of the mods sends you a note stating such, you're still fine. In the last 5 years, we've lost more free stuff than I can count -- some of it truly incredible and better than much of what of what is offered for sale. It is never cool. I'll never be able to get some of the cottages that Ironhart made -- and becuase they were so unique and special and, well, beloved, it'll be a long while before anyone ever makes replacmeents that are as good. It sucks. But we live with it -- and when we can't, we get wings and teach ourselves how to make the stuff we need.

Life just keeps f***ing me over! If it isn't a death in my family, it's something else! Sarte, I'm not trying to be a jerk here ... but these things aren't only happening to you. They are things that happen to everyone. You can't control the things that happen TO you, but you can change how you react to them. Take a step back for a moment. I say this from the heart ... breathe deep and let this pass. Try to respect the honor of the man who passed on instead of focusing on how his passing affected you. His work should be an inspiration for you to achieve higher goals instead of dashing your hopes to the ground. shogakusha, thank you very much for trying to help Sarte, it was very kind and gracious of you. It is unfortunate that your assistance seems unappreciated. Some of us here respect and uphold the honor of Taruru-san, and feel very bad about what happened here. I am sure he is very grateful that you spoke on his behalf.

I have just checked the Readme files of all of Taruru's free stuff items - In all of the his readme's is the following statement:

"The character [insert name of model] is copyrighted [insert date of creation] by Taruru.
All Rights Reserved. This may be used only in your non commercial, personal artwork."

Below is an email address that you can try to use to contact Taruru's family!

mk_taruru@hotmail.com

The Bottom line is:

  • Taruru did not intend for any of his items to be used for anything besides personal use!
  • As Taruru is deceased - ONLY the legal owners of his products can give permission of the use of any of his products.
  • Since the item that you are requesting is no longer available, it would be reasonable to assume that the new owners of Taruru's products no longer wishes that item to be distributed.
  • Several of the Poser artists have most generously offered to create the item as close to the one that you are in need of for free - which is a very thoughtful :)
  • As Taruru can not speak for the current distribution of his products, and the particular item that you wish has been pulled from both the Rosity and the Mirror site, it would be unethical for any of our members to send you a copy of that product.
  • Also ... when posting to the Forums, please keep the following tearms of service in mind:

"Members and users are expected to conduct themselves in a manner that is constructive and respectful of others at all times. Additionally, we would hope that each member/user would do their best to facilitate a culture of collaboration and positive reinforcement, so that we can all share our passion for art while realizing our personal ambitions, and developing friendships."
