I have registered on this site and wrote an IM to "maxlara" that he has to remove my pic in the next 24 hours. But I don't think that he will do that.

How come we say 'It's colder than hell outside' when isn't it realistically always colder than hell since hell is supposed to be fire and brimstone?

I think this man,  his 1002 picture he post, he have 1002 violations of copyright. And member section photography like member in other section here in RR... or other web...

I think it's more than evident that the photos and Poser work were lifted from Rendo instead of other sites, as the Rendo user names are included in many of them.  That ISP needs to shut that site down.

kimie... no like that, because he put for example : Bearcicle by Rayburg . like you see in the screen capture. But yes, he erase the name in the picture.... I never received a im or email from him for ask me if he can to upload my pictures.

I wonder if the people in the Poser forum are aware of this?  If we're trying to generate artist names, they should be included.  The more, the merrier.

I'm agree with you but if you see all this webpage, you can see this member isn't alone to make this error. I see a lot member put image without the autorisation... i just see a lot of picture of britney spear or other artist, for example... I think , the first person to make mistake in this Xwall is the admin and moderator for don't verificat  all the images to post all the user....

I think the more important it's informat all the member RR to have his own picture or work in the gallery of xwall, no?

Incredible..!: I got a message from Cosme (isacos). His image was the first one I spotted 2 days ago. I sent him an IM with the URL and here's what Cosme did: he registered on the site and left a comment under his image, in which he kindly asked gdmora to remove the image and to ask permission first before uploading an image that wasn't his own original work. Gdmora removed the image and sent a message back to Cosme, saying: "Apologies, I didnt know you were the author... next time I'll be more aware, keep well." Mind you, the image caption read: "Tximist by isacos"... and the guy pretends not to know that Cosme was the author... Incredible... he's a liar as well...! By the way, Valou and Loloe, if you just copy the page address that you find on top of your browser to show us the images, you'll see that you always end up with the same address... and the links to the images will not work. You'll have to right click on the image and open or copy the image address itself to display the images.

Thanks Margana..smile.... had some time today, as i had to stay home, cause we are getting a new heating for the house and its really cold outside by now and I have to make sure, my parrots are warm and well and this darn electric heater doesnt burn my carpet...

Zacko, open your firefox, and without to move the mouse, you click right, tape enter with the keyboard and you have the windows where you see propriety after the window of "copyright :lol: closed. I make that... With IE you cannot, or I don't know i don't test...

It is a -VERY COMMON- misperception that 'copyright law doesn't matter if I do it free'...

It is especially common in online forums, websites, file sharing, etc...

In almost every debate about copyright online, some yahoo comes in and claims they can copy and repost and so on because they aren't charging for it, or they are just using it for their 'personal uses' - as if posting it to the world was a personal use...

A lot of website owners fall prey to this same incorrect belief - and the presence of products like napster, utube, and so on only contribute to this belief.

But copyright of course, doesn't work that way.

If A hold copyright to X, B cannot copy it without getting permission from A. End of most of the discussion. Doesn't matter how B uses it, barring a small list of exceptions. Those exceptions mostly relate to academia and reviews. They do not cover general free distribution. But a common belief is that they do.

Further, you cannot disclaim liability for an illegal act if you are the party knowingly enabling that act. Which is the case here - as they first set up a form for people to use to break the law, suggest to them how to go about breaking the law, and then try to claim they are not responsible if people then actually go ahead and break the law. It doesn't work that way.

Spanish law, as a member of both the European Community and the EU, is not going to be that different from US law on this point - that site owner could be hauled into court by anyone of the people here who's work has been stolen.

Note also that unlike trademark, not hauling them into court won't cause you to lose your copyright.

If there is anyone who's work has been stolen who is in Europe, people with an interest might want to pool resources around that person in order to hire a local lawyer to draft up the EU version of a cease and desist letter.

Getting a notice with a law firm's name on it is often enough to scare people out of their illegal acts.

Truth has no value without backing by unfounded belief.

I have just recieved an email from Xwall asking me to remove all the images taken of Renderosity.
This is the text translated literally: "Due to problems with the page, Renderosity Digital Art Community, I should ask you to remove of XwallOnline.org all the images uploaded from that web. It dosent suit to them putting the name of the author of the image, not anything."
I hope the translation it is right and maybe some of you is receiving the email if you have registered in that "web".  For me is a shame this web is owned by spanish people.  Hugs to everybody !

To me, the standard email sent to xwalls members is a cop out.....If they were really concerned they could have gone and deleted all the affected images themselves rather than ask their members to do that.  Then after that, issue a statement to it's members discussing copyright matters.
As it sits right now.....the onus is on it's members to remove YOUR images....that may  be a long and painful process.....some members may not even be active anymore....

In addition, their statement only addresses Renderosity uploads.....I guess they still condone the practice if the images are stolen from elsewhere....

In youth, we learn....with age, we understand.

First off thanks Ulla for tracking down these images and giving us the links....That's a lot of images to go through to get the URLs.....

I joined this bogus site to check out what images they might have ripped and did find mine there...pretty sickning to see it on another persons site with out permission. I also got an email from jlluesma@msn.com with this message in spanish:

Hola,

Debido a problemas con la página, Renderosity Digital Art
Community ( http://www.renderosity.com/index.php ), os
pediría que eliminarais de XwallOnline.org  todas las imágenes
que habéis subido de esa página Web. No les vale con que
pongáis el nombre de autor de la imagen, ni nada…

Yep - got the same email. I for my part have to retract my previous assumption, that it was a minor issue. Seeing that we're talking hundreds of images and several people having part in this image theft - it appears to be a large scale problem.

I am astonished - that there is no official statement from Renderosity available at this time.
Whether or not they as a company have taken any official action - and if yes - which.

I applaude our moderators however, who try to get a handle on this, as I especially point out Ulla for her excellent research.

When are we going to learn about the official R'osity point of view?

More good news to report...

all three of these folks will not be visiting Renderosity  again..

I'll do my best to keep an eye out for any of them coming back under a different name.

As for xwallonline

We need to stay on top of them. Obviously their host company said something to them..

I would suggest that everyone who got one of these e-mails from them, take the time to respond, in a polite and firm way.

feel free to mention the offending parties...

If we do not see some definitive action in the next day or two..Then we can continue to press the host company..

Perhaps one of our Spanish speaking members can assist us in drafting an e-mail to send to the admin@xwall..

I will see if we can find an e-mail addy on that site

That's Stacey's response so far - and I can't help to say - this is unsufficient - to say the least.
If Renderosity suggests that it is our problem and we have to take action then someone is missing the point.
For one - if we as members are not being supported by R'osity in a problem that is obviously almost epedemic - why should we keep posting our artwork?
The artwork of all artists is Renderosity's backbone, thus I am astonished by such an indifferent statement.
What good would posting it in another section of the forum do?
It will be exactly the same discussion as we have it here.

I'm sorry - but that is not what I expect.

well, to the admins defense...I took it upon my self to run with this matter..

I have been in contact with both Stacey and Clint along the way..Thus the lack of response from them in this thread

We do however need to work to a long term solution..

That may take some time..

If any of mine have been lifted, I don't know it yet....maybe not good enough to lift but a few are...This is truly sad but in my years of life I have seen everything from photos to machines and jewelry knockoffs, to blackmarket movies..available for sale.      

Funny, like a one in a million side effect of a medicine, for instance, affecting a very small percentage of the populace..when it affects you it is 100%!    If someone steals your photo or mine, it is 100% and very, very wrong.   The world is full of those less than ethical low types, unfortuantely.

I hope those here with lifted photos can get  some sort of proper recourse.  I really do hope that.

As much as I feel for all who have had images lifted, I think the administration have  done fairly well in responding in the past.
That is when it is brought to attention.
This happened before while I was a moderator, and Stacey was always involved with it on the  upper end. The mods do the main reporting back in their forums.
As long as there is internet this will happen. I doubt this site would survive if they had to have satff monitoring  the www for all stolen images from here.
It is like asking why do people break windows or steal cars. It's going to happen...governments can't control it either.

 More to note that it is also the same offence to copy and paste emails or personal messages. The same goes for  taking a screen capture of this site with my image on it and posting it in a forum elsewhere.
Can you imagine....some of these very members who want their work protected, yet do it themselves.The irony of it. I think they should be dealt with the same as staff  are  right now dealing with this issue.

But as Gradient said, and  I  have before,

This is so correct.

I know we all would like our images to look as good as we can, but the only real way to stop it is to write your name over the middle of the image and perhaps in other places.
There is also ways to script images that when a thumb is clicked to enlarge, and other click on the image closes it. This makes it only available to a screen capture, therefore making a certain population  unable to save it as.
The ones who will get it know the ways around it.
There could be stricter enforcement of first time offenders caught within the site posting copyright images.They may get some of the offenders, but as they are,another is just around the corner.
 @kjpweb.. yeah...I agree , this is epidemic and  perhaps there should be some meetings held to try and come up with some strategies.Because it is nice to have a community site to share artwork at.
 But it is almost like asking the police to go investigate someone who steals the car stereo. In this city it ain't gonna happen.

I won't be around this planet long enough to spend too much time worrying if someone grabbed an image from me.But if I ever change that train of thought, then silent and vigilant is the way.

I just had a quick look at the site and on the first page I found  la forteresse noire pour jeanpepe I reconised right away as Jeanpepe in on my Fave Artists list. It was posted (stolen) by gdmora.

If it ain't free, I can't afford it.

Just wanted to let you guys know that I found a work that I did- they said that it was by Caspergirl ir think it was - it isn't even me....I hate that you have to become a member to even look at your stolen artwork....
