this is very misleading and not all together accurate. a victim of a crime cannot be held culpable for the crime committed against them. if i leave my front door open i may be foolish but i'm certainly not culpable. it is illegal to steal anothers work no matter what pecuniary value it has. the work in question doesn't even need to be marked copyrighted to be protected under the law. actuaaly copyrighting a work makes it easier for judgement because it states when it was copyrighted which precludes anyone at a lter date saying they did it. if yiu have proof of when you made the artwork there's littel difference beteen a registered work and a non registered work.

Does that mean they are linked up with RR by permission?????
Personally, I wouldn't mind the use they are trying to get across on that site if they did it appropriately. If they are going to use our pictures then they should be posting the artist name and where they got the picture. Plus a copyright statement in spanish right there under the picture.
I also agree that it seems we need to take further steps to protect our photos here on RR.

The big problem here is that "invisible, embedded" copyright notice will do NOTHING to prevent the type of image theft just experienced. The images will have still been ripped and would still have appeared on the other site. What these services do is they provide a method to PROVE that you are the copyright holder.
Some provide online tracking services that do give some method of notification of use however they are not perfect. Nor do any of the embedded copyright notices help once the image has been printed and sold.

**Agreed....although it should be in Renderosity's interest to help minimize image theft from its members and its site....If people just come here to rip the works of others, at some point people will stop uploading their work.

@Bentchick: you're right, there is a direct link to Renderosity on the Xwall frontpage... I never noticed that. Question to the mods or admins: :b_confused: Is the Xwall site in some way sponsored or supported by Renderosity..?? :b_confused: All sorts of questions and half conclusions jump into mind... But it's best to wait until that question has been answered. Please, can someone come up with a plausible answer..?

The only way that an embedded copyright or other form of copyright is going to work is if you plan to sue the person who has stolen. I workded for many years as a graphic designer in an ad agency in San Franisco and we had someone steal the " Mock Up " that we did in our proposal to them. We found it in a magazine, and were able to sue. I dont know if it works differently or not for work done for a person that is stolen or not.........But I do know that the only difference that copyrights or watermarks make is in a court of law. I just yesterday found an image on there by Donakuka that was dedicated to me. I saw no mention of her name as the artist, altho the Title included my Rosity name. I decided to save the file to my hard drive so I could check it on rosity and I found that the name of the .jpg included the Title and DonaKuka's name as the artist. Confusing at best......
Oh man, this is making my head spin. I am fairly sure that RR isn't endorsing this site in any way. To me, those links look like a road map to the 'supermarket' where these folks can go and lift work. A shopping list or menu if you like seeings as how they have dA and digitalart.org and others there too.

I have emailed the site and demanded the Renderosity banner be removed immediately. I gave them 24 hours so we'll see what happens. We did NOT give them permission to put the banner up on their frontpage (probably none of those sites did) and they are not a part of our LinkShare program cause if they were, I would just delete it:)

You know, as I was browsing this particular site, I couldn't help but wonder if these assholes realized that if they spent as much time actually producing their OWN work as they do ripping off the work of others and posting it elsewhere, they might actually feel pride in themselves. Pride was obviously something never taught them by the animal that calved them.

You have to understand that we are NOT the copyright holders so therefore are hands are tied legally on what we can do. We have given you as much information as we can to help you (the copyright holders).
The reason we can contact them about the banner is because on that WE ARE the copyright holders.
And believe me, I had a few words to them on why they don't have permission to use our banner because of what some of their members were doing with some of our members photos:(

Since I am not the copyright agent here at Renderosity, you would need to pose those questions to either the Copyright forum or contact directly the email, copyrights@renderosity.com
But even though I'm not the copyright agent, I do know that as the copyright holder of your images, we can't speak on your behalf legally. We are limited as to what we can do which is what I was stating above.
Any additional questions or concerns, please submit to the copyright agent for Renderosity by either posting in the copyright forum or emailing the address I gave you above.

any news on the suggestion forum stacey if we had one some of gradients ideas could go in it.
as for the admin and other peoples copyrights what you say makes sense to me.
gradient. maybe you could do a tut as to how someone should act upon infringement and ask if they'd put it in the copyright forum. anyone who then has a prob could be guided to it, it could include everything you suggested. if i knew enough about c.r i'd do it myself.

Why would you say that? I gave you direction on who to contact to possibly help with some of your suggestions? Copyright laws are a very tricky thing and I am certainly no expert but if you pose your concerns or questions to the right area at Renderosity you can get more accurate answers/response regarding copyright issues.
I lost my membership after leaving comments about copyright underneath some images and have not been allowed to re-register. I think they are being very careful over there.

They banned me rather quickly..perhaps the renderosity e mail addy was a giveaway.......
If I recall, the domain was set to expire soon..maybe the host declined to give them a contract..
gee that would be too bad wouldn't it..

FYI, I came across this message from the ClickTelecom team, the telecommunications group that bought MetropoliGlobal, the hosting company of Xwall: " Hola Debido a una serie de problemas que se han presentado en la plataforma, vamos a realizar una desconexi completa de metropoliglobal.es para poder solventarlos. as to the copyright thing....my work is what I call "sig mapped" I actually keep a copy of said map per picture. it shows where my hidden marks are and what layer they are at etc etc etc...
THEN I have a HUGE signature on it. every time I post I proclaim that it is copyrighted and NOT for use PERIOD. that if they wish use they have to contact me and permission is NEVER given over email.
WHAT ELSE IS AN ARTIST TO DO?
we have a right to display out work where WE choose it to be.
