I thought I'd post my page here with my latest creations (using FaceShop Pro, Poser and Photoshop). I'm also attaching an image, but if it doesn't appear here, just go to my page link. I try to update my site whenever I've created something new. Since July has turned into "Harry Potter" month, I thought it'd be great to dedicate some works to them. I'm a big fan, and am looking forward to both the movie and the last book!

as noted several times, the issue is about unlicensed use of copyrighted materials. Celebrity likeness is a whole other kettle of fish. We do not market celebrity lookeylikeys here.

Lara Lara for Vickie: Kate Moss never inspired the set below: Kate for v3: Jeri Ryan Of course, Voyager Knightslooks nothing like her. I have an issue with what is being said, not the merchants. ~s

Not having a problem with the examples, karen. I was pointing out that your flat statement was a falsehood: Evidentally you do market celebrity lookeylikeys here at the RMP. None of the examples given above are marketed as lookeylikeys. Some of the advertising copy states that they are inspired by "celebrities". All of them have been run past the marketplace admins and found acceptable.

sigh It's just one more example of the total incompetence of Renderosity's management & business planning. They obviously don't have a clue about how to run a website properly.
Karen - allow me to quote Merriam Webster at you: "Pronunciation: 'mär-k&-ti[ng] Function: noun 1 a : the act or process of selling or purchasing in a market b : the process or technique of promoting, selling, and distributing a product or service" A celebrity has an instant recognition factor due to their face, or a concept due to a specific outfit, i.e catwoman. Renderosity provides a sales-channel for digital copies, or rather, likenesses of said people and concepts. Wouldn't you concur that by the above, neutral, American definition, Renderosity does in fact sell/market lookalikes? Some of these products have been put in the newsletter - does that not constitute making potential purchasers aware of a product, and that that product would sell exactly because of that likeness? ~s

I used "marketing" in the sense of "to advertise or promote something to a specific audience or revolving around one particular facet of the product."
For example: Cigarettes were once marketed to women as appetite supressants.
So to reiterate: we do not market any of the above products as celebrity lookeylikeys.

When in doubt, hairsplit innaccurately? :) They're recognizeably "lookeylikeys" - celebrity lookalikes - wether they're labeled as such or not. You sell them, you provide advertising services for them - vendors banners, peripheral benefits of Renderosity marketing, front page exposure, newsletter exposure - you market them. ooooh! Insults! When all else fails - throw an insult and go have something better to do. Karen - You know extremely well what we're reacting to; To compare Renderosity's facilitation of celebrity lookalikes to the marketing techniques of the tobacco industry in the first half of the previous century is creative, but far fetched. I've yet to see a Lara Croft ripoff being marketed as a slimming device for overwrought and overweight hausfraus - but the lookalikes have references to their originator in their copy - and what else is ad-copy but a marketing or sales-device? And it's beside the point. The entire issue is that it's a paradox that rendo has become hysterical on image posting in threads, even if it's a promo image - promos exist with the sole purpose of being propagated, getting the face or product out there, especially when in most cases fair use applies. But hey - we're all concurring that we're entitled to our opinions, and that we're clearly in disagreement on this. That doesn't make me a bad person, or you an incompetent twat with the legal skills of a flea-infested camel. I'm off to watch some cult-film and drink some more tea myself - ta-ta for now. ~s

In no place here does it say "Jeri Ryan," or "celebrity lookalike." The most it says is "CGI Personalities Series," CGI meaning Computer Generated Image. Meaning that the computer generated it and that the images obtained were not from a photograph that needed licensing. The only place where the assignment of the images to Jeri Ryan is taking place is in the mind of the beholder of the image. No where else is that assignment taking place.
When I was buying my first house, I told my lawyer that I had X amount of dollars in my bank account to make the down payment. And my lawyer said "So, you represent that you have X dollars in your bank account for the purpose of making the down payment." And I said "Uhhh... yes."
In law, everything is a representation. In no place in the above ad is it represented that the CGI image is that of Jeri Ryan. A representation other than that may take place in the mind of a beholder, or purchaser, but that has nothing to do with the representations made in the ad.
The makers of the ad have no control over what representions another party may make.
Furthermore, there is some subjectivity in various representations about the ad's images. Some who have watched Star Trek Voyager may represent that the image is of Jeri Ryan. Some who have ever seen the series may represent that the image "sort of" looks like Jeri Ryan. While someone in a culture where blond women are rare may represent that the image is of a US Embassy secretary they saw crossing the street the other day. Representations are very subjective things, which is why lawyers always translate assertions people make into "representations."
I represent that the problems we have been having on this thread is due to the fact that some people have been using photographs for which they had no license, while also representing that the images they've made are those of a named celebrity. The ads do not do either of those things. So what the ads are doing, and what has been done on this thread, are two different things.
I do not have a problem with what the ads are doing, except that the buyer of one of those images may be the one who runs into trouble if he or she uses it in such a way as to represent who the image is susposed to be.

Renderosity is a website situated in a country where freedoms are being whittled away day by day and it's just trying to stay legal. If you're an American, it's no problem, you have a ballot box where you can change the government. Same goes for Denmark, incidentally!

Fundamantally I have no problem with Rendo selling celeb-type images that may or may not resemble know people. In either case it is an "artist impression' and as such protected as much as an oil painting or statue is.
The issue here is that this moderator applies her censorship selectively, i.e it is OK for Rendo to do things but God forbid it is not OK for other artists and vendors.
In regard to the intolerant tone, same comment: I was lectured that I was not "customer friendly" for taking offense in some comments; now who is not "customer friendly", I may ask... It seems that Karen was found guilty on the same account.
I was tempted to place an image alongside with these comments but frankly I am horrified to do it. I think Rendo should mellow out and not be so intimidating or militant about things:-)

I requested a reset on a purchase nearly a week ago at DAZ, and fortunately I found the missing EXE while I've been waiting without so much as an autoresponse. DAZ response times are unpredictable and, to put it tactfully, subjective. Like Lazlo, they seem to have a bit of trouble understanding how companies need to interact with their customers; unlike him, they cover that lack of understanding with a thick frosting of car lot niceness.
It's grand that so many folks have good luck with DAZ. I do think HeRe is being a bit unreasonable to expect rapid response during a time when they have been buried in sale traffic, but it's also true that I got screwed over so many times trying to recoup my Hex investment after Eovia sold out that when 2.2 was announced and I discovered that DAZ had lost my ownership records again, I gave up, bought a PC month, and got another license.
