Well I'm sure you guys remember that I was in a car wreck a few months ago.

The guy who hit me was in court today and got well and truly screwed by our magistrates.
The fined him £150 plus costs - a total of £225 ($450) AND they took his driving license away!!!!!!!

To get his license back he has to apply for a driving test again and pass before he can go back on the road. He now has a criminal record and his car insurance will cost him about half a planet. Not to mention that he had to buy a replacement car.

My son and I plus our wives were in court to hear the case and the magistrates were told of the fact and we think that was why he got a good seeing too.

FANTASTIC RESULT!!!

Now we just have to wait to go to court again to sue the little sh*t. We haven't finished with him yet.

damn... i hope for that kid he has some rich parents :-/
If i imagine it from my own perspective...

  • £150, i can afford that.
  • another £225, i can afford that, but it would defenitely hurt my wallet.
  • losing my drivers license, ouch, that would be painful if i had one because its expensive to get it back, that should get to him...
  • a new car... cripples my finances for at least 3 years, assuming a decent raise next year and the year after and would put my moving out plans 2 or 3 years into the future as a result. Seriously tough one there...

Then to get the insurance company after me as well?? the people that are experts at paying as little as they can while squeezing as much outta the rest as they can? scary... very scary considering the financial blow of the points mentioned above...

Good stuff Bryster! I hope it will make him think before getting behind the wheel again. I know it doesnt change what happened but it would make you feel a bit better.

Excellent Bryster! Best wishes to you! What else can he be sued on? Well, being stupid should be high on the list. Bryster I'm happy it's all turning for you. So, in England they're called magistrates while here in the USA they're called judges...do they still ware wigs?.

Forget the courts Bryster. Stick him in the comfy chair for a couple of days with extra throw pillows, a couple of doilies, a comfort blanket and the stay sharp knives. The silk covered handcuffs (Red) with the lace should bump him over the edge.

Well basically the kid tried to lie and get outta it blaming the accident on bryster while actually the kid was the one being irresponsible.
Still i kind of agree about the vengefulness.. dunno how young the kid is exactly or how rich his parents are, but considering the costs plus losing drivers lisence and mainly the part of having to pay for a new car... if the kid had been me it would defenitely cost me a few years of financial crippledness. Basically slowing down my life's plan a few years... I'd consider it a huge impact on my life so far if it was me in the kids shoes.

That's the way to go Chris...............sue the pants off the guy.

For you who are not aware of the legal system in this country, Chris was in a crash, and the stupid wazak that was driving the other car tried to plead it wasn't his fault, even when it obviously was.

Chris drives a "motability car"...this means that Chris is registered disabled. Chris is also well over the age when he has to worry about what age he is..........the other driver was a kid.

In the UK at the moment it seems you mustn't penalise the young yobbos too much, because it might traumatise them, and set them on a life of crime.

I say B******T.....................If you don't punish these guys now the they will just keep on doing the same thing.

However in the UK just lately the b****Y law is an ass. Whereas over in the US this guy would have been banged up, here he gets a fine and an ASBO. That stands for anti-social behavioural order. Basically he has been told...don't do that again, if you do we will take you to court.

Big deal

Chris and his son both suffered significant injuries.

So the guy got a few quid fine, well Ok a few hundred quid, but he probably doesn't work anyway, amd therefore his fine will be paid from the benefits he gets from the state. Also I seem to remember he was not insured, so Chris cannot get compensation from his insurance company.

So he has to sue for Trauma, injuries sustained and all the rest of the stuff.

So I say it again Chris........SUE the pants off the guy.....................Please.

Just want to add, as an edit , that the young yob will probably be driving around again already, in a stolen car with no insurance............so somebody else will have to go through the same thing.

You might guess that just this same thing has happened to a friend of mine, only in this case the driver of the other car was an asylum seeker,,,,,,,,,,,,same rules apply.

The greatest part of wisdom is learning to develop  the ineffable genius of extracting the "neither here nor there" out of any situation...."

Point is Ray, from what I know of you, you wouldn't have behaved in the same manner as this kid, that was not needed and part of what made things worse for Chris.

Well it seems I gotta clear up a few points.
In the local justice system we have a Magistrates Court run by......you guessed it.....Magistrates - 3 Guys/Gals who decide between them who's guilty etc. This is the court that deals with guys getting drunk and a bit naughty, shoplifters, minor drug offenses, traffic violations like speeding and parking offences and such.

Go up one level and we get Crown Court. This is more serious and we get to meet Judges who deal with serious robbery, firearms & knife offences, the odd murder...............etc.

Then we get the High Court and quite literally the Big Wigs (Yup Quest! They still wear wigs).....highpowered Judges for cases like mass murder, treason, big fraud cases, using apps other than Bryce.......

So back to the case in hand,

He is 19 and what we call a 'boy-racer'. A kid with a new driving license who drives a small but powerful car recklessly  and hopes he doesn't actually kill someone but if he does, hopes he doesn't get caught.

Now the car was his. He was insured. And he worked for his dad. He wasn't legally drunk. But he had been out on a binge for the entire weekend.
He slammed into me while I was at a standstill at 50mph, putting me and my son in hospital.

nruddock is right.  This was the case that dealt with the criminal offense of 'driving without due care & attention'.  I had no part in this case other than that I was permitted to observe the proceedings along with my son and our wives. However, the court was informed of our presence and therefore understood that we (the victims) were taking the matter very seriously in deed. This generally helps the case for the prosecution because if we didn't turn up everyone would think that we couldn't care less.

The next phase is the bit where we sue him through his insurance company. In other words, my insurance sues his insurance at no cost to me. The only question is 'how much are they willing to fork out for my trauma, injuries damages ect.

The fact that he has been tried as a criminal adds to the weight of my case against him.
However, from the moment he hit my car it was out of my hands. Being a Motability driver the police have to step in.  From then on he was on a hiding to nothing. 

Why am I so vengeful?
Chohole said it for me. I am disabled. So being hit from behind at 50mph by a kid who didn't even hit the brakes doesn't do my health any good. My son was also injured and is still having problems. Also that day, my grandson was offered an afternoon out with his dad and grandpa riding in grandpa's new car. Well someone on high was looking out for him 'cos he said that he's rather stay at home with mom. He's never ever done that before.

My son and I ended up in the hospital, myself having to be backboarded out of my car by the fire and ambulance guys (I love you long-time).....you do the math.

And yeh...the kid tried to tell Daddy that I was rolling back down the hill - I was driving up the hill - in an car with an automatic gear box, but was stationary at the time of impact -, and, that he didn't see me on a clear day in perfect driving conditions.

This was his second crash in a year. If I didn't do my best to get him off the road he would have killed someone - probably still will if he passes another driving test.

He ruined my life for the last 4 months and I'm still trying to put the whole sequence of events into perspective. 

I really appreciate you guys and all your thoughts. I'm always amazed at the support this forum gives to each other. Thanks. You're all worth your weight in gold.

On a lighter note, I kept asking myself 'what did I do wrong?' a bit like the only guy who survives an airplane crash asking why was he the only one?

Then I remembered asking the cop who took my statement at the hospital the same question.
He said, " You got out of bed this morning..."

maybe all of this will teach other kids around your town a lesson.. ..excellent idea.
Little me would opt for the being nice to him while you sueing him again...a double edged sword. he won't know what to think then....

BM: Not a stupid question at all. Yes they fo wear wigs, but only in the higher courts where the more serious crimes etc are processed.

great news Bryster, yes sue the pants off him but please make sure he paid for them or you could be done for handling and receiving stollen goods 😉

Over her in Australia we have a law now that if some young hoon gets caught hooning around in their car 3 times it gets taken off them and inpounded or worse crushed and delivered to their house..
I have seen two news reports now where the car was crushed..this only happens if they get caught doing burn outs, racing or anything the law deems dangerous to others.

I have opinions of my own -- strong opinions -- but I don't always agree with them.

(If that doesn't confuse and scare him nothing will.)

What I mean by that is that Ron Hubbard in the long ago once wrote that you should keep out of courts if you can as they will only steal your money and your time and any monetary gain you might realize from the lawsuit would only go to pay off the lawyers.

From what I know about Ron Hubbard, he would steal your money!

As much as I hate to say it , i think the only way to make him stop and think of his actions is to sue him and to crush the car as well! I know the money doesn't help take away what happened but it may give a sense of justice (not revenge bryster dear, that is for mean nasty heretics!!) for the pain and suffering.

Old is not an insult. Every year I live I see more enemies laid out in the dust behind me. They're gone and I'm still here doing just what I want. Unlike the mercenary Miss erosiaart most young girls blush and titter shyly when I speak, while their mothers look on smiling knowingly. Young men step out of my way. 

When I mentioned a student friend of my daughter was interning at work she said, “Yes he wanted to ask you about me, but he felt you were too intimidating." Salt-and-pepper haired me, intimidating? Six foot four glowering who can still spin his full grown daughters around in the air, intimidating? Geezer who looks down an inch into Kevin Sorbo’s eyes when he shakes hands, intimidating? I realized I had slowly become one of the silverback alpha males of our tribe.

 

You managed to smack down another young punk who sought to run around and do whatever he wanted. You went to court because your presence would have influence over the decision. Not your words or actions so much as you watching. I’m here, I looking, now do the right thing. It’s your age that earned you that respect. Revel in every gray hair of it!

almost 57 and I can still roof and keep up with the guys half my age most of the time so the point on age is valid.
