it may be considered a restraint of trade to specifically target the messiah thing, but they may have some section of their TOS here that covers peer referrals in general.  I ain't a lawyer.

unfortunately, the other places where they could post these ads are either more restrictive, far less popular, or difficult to navigate, hence there will likely be more here.

Personally, I don't mind this sort of post at all. I'm not into animation hence not particularly interested in Messiah, but if say modo or Maya or 3D-Coat or ZBrush were doing something similar, heck, I would want to know about it! This sort of post is certainly a lot more relevant to what at least some of us do than all those "OT: My dog had kittens" or requests for medical advice we've been seeing. Perhaps we could come up with another prefix? But then, the well-meaning souls who posted this probably don't post all that often and so the concept would be lost on them.

I'm just glad that the moderators at least don't see this as a TOS violation. It would be if the company themselves were doing the notices, but it's enthusiastic users like you and me who want to share the love. And who gets on the 3D Links forum? It's dead and dusty in there.

RENDEROSITY may immediately terminate any account which it determines, in its sole discretion, is transmitting or is otherwise connected with any 'spam' or other unsolicited bulk email. In addition, because damages are often difficult to quantify, if actual damages cannot be reasonably calculated then you agree to pay RENDEROSITY liquidated damages of five dollars (US $5.00) for each time a spam incident is traced to your RENDEROSITY account. Otherwise you agree to pay RENDEROSITY's actual damages, to the extent such actual damages can be reasonably calculated.

An enthusiastic heads-up about a product going at an incredibly low price by another member who is not in any way affiliated with the product or company selling the product isn't exactly spam, to my view of thinking.

So far, its been single posts from many people and no emails.

AFAIK, there are no posts from the company that made the software.  So far, its been just us, the consumers letting other consumers know about a heck of a deal.

No, I wasn't scrappin with you.  I just want to read where in the TOS it actually says these are a violation and why the OP thinks so.  I didn't see anything about a commercial related post restriction.  The only options to mark a thread is Language, Violence or Nudity, none of which apply.  There isn't anything that restricts a post of commercial nature.

I don't see any reason messiah can't be related to poser and used together in your graphics work pipeline and therefore a reasonable OT here.

Multiple people posting about a single subject can't be considered spam.  A posting about a single subject multiple times (ie crossposting) can reasonably be considered spamming.

My view is that anything legally questionable, such as a ponzi scheme or a pyramid is spam, but that's just my personal view. I was responding to the fact that the moderators have deleted about 5 threads on this, and thought perhaps we might deter the posting of yet more threads to be deleted.

Of course, the moderators are free to delete THIS thread if they fell I'm wrong or have overstepped some boundry or the other.

I personally could care less either way.

Renderosity will not be held responsible and/or liable for information that members choose to share via these tools. We strongly recommend that members exercise forethought and caution prior to disclosing any personal information while using these tools.

 

Spam,  however, is defined as using electronic media (such as email, sitemail, and forums) to send unsolicited bulk messages.  

 

The reason it's advisable, on any message board, to READ what has been posted on the forum is so you're not accused of spam.  There have been around 10 of these posts in the last 24 hours.  It's not hard to spot.  

 

IF EVER there is a question on whether or not you should post something, PLEASE ask a staff member first.  There are several of us listed up at the top of the forum.  And, if you check the "Who's Online" link, you can see staff listed at the top.

If the heads-up was about an interesting offer of a product I would consider it a helpful contribution to the community.

Instead, in this case, it was a very strange offer give-us-your-money-and-maybe-we-will-give-you-the-program which in the best case was a very fishy behaviour and at worst the cover for some credit card/payal account info harvesting.

In addition, we are not talking about a new program willing to enter in the arena but about an established 800-pound gorilla which requires no advertising at all: a 1-week 50% discount to increase user base would have been credible, a 1200->40$ (97% discount!) is terribly suspect.

Remember: if it looks too good, something does not add.

Bye... from somebody whose personal motto is: Once fool, shame on you, twice fool, shame on me!.

P.S.: the fact that the poster had just a 6 posts history did nothing to increase his/hers credibility.

As I said, I did search the poser forum first and found none.

Anyway, that clause is pretty darn broad saying that ANY post that contains unsolicited advertising is against the TOS.  So what exactly constitutes advertising?  Someone saying some software is on sale even though they don't work for that company?  That considered advertising?  The link Purchase Poser at the top of these forums could well classify as unsolicited advertising, I didn't see a post asking where to buy poser and that put in a response.  Its selling poser.  Wouldn't the thread Poser Debut - Coming Soon! also be classified as against TOS? (NO, I don't want that thread locked or deleted because it helps get new users into Poser)

This is what I get when I search for "messiah".  It turs up NO other threads other than this one, which BTW, postdates MY thread by 20 minutes.  Why no others that you say there have been 10 in the past 24 hours?

Policies like this are intentionally left pretty open in most discussion forums, because when you nail it down too exactly, people look for ways to weasel out of it, which tbh is really annoying.

the deal is NOT a ponzi or pyramid scam. they are a respected company trying something out. they even state, clearly, if it does not work they'll be refunding the money. note the payment options - credit cards - with all the protections they offer, by law.

To a degree, I can agree with that and if you search for my posts, you will see that I have only made one post relavent to anything commercial.  However, I think they are going too deep with it here.  They are either deleting or locking any thread with any hint of messiah sales deal in it. 

 

I am objecting to the unfair treatment of the messiah links opposed to all the others throughout the forum that could easily fall within the TOS restrictions.  Heck, your sig could get you banned (it contains a link to an offsite store) if they followed the letter of it.  (and NO I don't want you changing it or getting banned over it)

SilverDolphin (Dare to share in DAZ Studio forum)

testingrocky (Dare to share in Poser and Vue forum)

have a mission to spam.

They joined years ago at Renderosity and only post spams. Why not delete their accounts and finish this? You can't debate with spammers and they are considered in some countries as criminals.

If they don't have the money for advertising it's not the problem of us Poser users who use this forum for other reasons.

You forget "such as comments that are advertisements". The phrase "such as" does not exclude it. I know this is a commercial site but if you further open the door for these kind of spam it's sad.*

You assume quite a lot.

 

Our TOS is broad, and we have policies that we enact.  There are threads in this forum (here's one) going over and over what is and isn't allowed.  And EVERY THREAD where a question of TOS-Abiding comes to light, one thing is repeated over and over.

 

IF YOU ARE NOT SURE, CONTACT A STAFF MEMBER.

Don't post it and say "oh, if it's not ok, please delete".  For several reasons, including if we have to delete/move a thread you post, it goes in your member record against you.  We don't like to have to do that, which is WHY every staff member parrots the same line.  ASK ME, PLEASE.  We're here to help you!

 

Anyway, the reason that you may have found none is that they were already moved to the proper forum, the 3D Links forum.  Several of them, actually.  Others were just removed from the forum for repetitiveness.  The point is, this is the POSER forum.  If Smith Micro wants to advertise that they've got a new version coming, great.  It's the company that makes Poser telling Poser users that a new version of Poser is coming out.  I already wrote a diatribe in that thread discussing why we leave their posts and won't let merchants advertise in the forum.

 

The point is, the "no advertising in the Poser forum" policy has been active for roughly 10 years.  Longer than I've even been a member of Renderosity.  This is not a new policy, nor are we doing anything new.  Anyone who's been a member and actually paid attention knows what is and isn't allowed, and to ask for help if there's a grey area.

Technically, I didn't really view these posts as spam. Just bloody annoying.

People are posting this in what seems like good faith to me so that others know about a good price on an expensive program related to 3D. That's all. I just wish they'd all get together and just post it once and give my ebots a rest ;o) Now, had the posts been about a very good price on Viagra, then I'd be screaming spam...lol.

I'd say that the difference is DAZ doesn't have a no commercial links policy in the commons so the the first thread that got there showed up in searches and any repeats were locked or just didn't happen because people could find the first one.

That being said, will Renderosity be considering a new rule for "Viral Marketing Campaigns" that allows the first post standing to stay so it can be found in a forum search? Viral Marketing seems to be the new buzz on the net these days and if it's not spam to send 1000's of people out to get your message out, what is it?

I got the same promo link from a friend by email. I was going to post it here but asked a moderator first. I don't do animation (no time) so don't really give a hoot about this product.

I think the promo seems too good to be true. The marketing people at pmG should of done a better job at allaying fears that "if something is too good to be true then it is".

pmG should of atleast said what the target was for the number of units to be sold. That missing little bit of details does make it all smell fishy.

Anyhoot if in doubt aways run it past one of the moderators first. It's their job to keep our playground safe and us children in line. LOL.

Probably not. 

Listen, the "no advertising in the forum" policy wasn't from the staff.  It was continuous requests from members.  Why?  Because people were tired of coming in to ask a question and not have it answered because it was flooded out of the forum by ads.  If you find something you TRULY believe in that you think others should know about, you have 2 options here.  We have blogs.  Write a review.  Or, link to it in your sigline.    Siglines aren't policed UNLESS they violate our Zero-Tolerance polices, because you can turn viewing siglines off in your preferences.

DAZ is DAZ.  Renderosity is Renderosity.  We are two different sites, with different policies.  We try to have a symbiotic relationship in some regards, but, in the end, each site will follow their own policies.

Second, I do agree that pmG should have at least posted what their goal was.  I've seen deals like this for years, and taken part in a lot of them.  Artfire (an online handmade/vintage goods shop) had a similar one in November, and I think their push was to get 1000 people to sign up, and if they met their goal, everyone who signed up would get their shop fees set to $5 per month forever, instead of $15 per month.  Groupon does similar, as does Deal of the Day, which I use almost constantly.  It's not a ponzi scheme, not a pyramid scheme...it's like the priceline commercial.  Getting customers to pay 50% for an item is better than not having any customers at all!

FWIW, I wasn't saying Renderosity should be DAZ. I was only explaining my thoughts on why there only appears to be one thread over there compared to the mass of them that we got here. Count me in as one of the people who didn't like seeing questions about Poser threads being drowned out by advertisments and spoke up on the subject.

I'm curious if the license file(s) can be stored on a hard drive for later retrieval...(in case the thumb drive is lost)...but in order to actually run the software... the license file(s) need to be on a thumb drive and inserted into a USB port.
Not unlike a hard lock dongle.

Like I said...just curious as to why the need for the thumb drive.

Amen Miss N.  It seems that any thread you venture into these days is likely to degenerate into a pissing match before you get halfway down the page. It's like people are itching for a fight and ready to take any comment and make the most negative interpretation. Usually, it's not even a controversial topic. I don't know if it's the economy or the way that corrosive politics seem to have seeped into everything, especially on teh internets, but it's weird. Creeping senility may have me viewing the past through rose colored bifocals but I don't remember this place being so volatile in the past - at least not over petty BS.

The complaining of advertising was mostly due to merchants. Some were posting every other thread. It was real bad. Even I asked to have it stopped. But I posted a Messiah thread because there was not one that I could see. I did it because it is something that I thought others would like to know about. Not spam in any way.

I guarantee I will never let anyone on this site know about any deal on anything ever again. Even when asked. It's really not worth it here.

Actually Only your government can commit restraint of trade with improper legislation there are certain types of  private contracts that amount to restraint of trade but neither applies to a web forum TOS.

did you see the first thread? the one where users were calling it a "pyramid scheme" and "Spam" and "ponzi"? based on what I'm not sure....

thats why it was moved. it wasn't the Mods causing trouble........

I have posted EXACTLY ONE post in the past 11 YEARS that could even remotely be considered spam (and I STILL don't consider it spam, but thats the current debate here). One post in 11 years is clear evidence that I am NOT on a mission to spam.  Only one post out of all of them is clear evidence that I do NOT post only spams.  You are spreading personal lies and mis-information about an individual in a defamatory way.  YOU just broke the TOS that you hold so dear and wish to use to remove others from these forums by deleting their accounts.

I agree with this.  They are complely different sites.  DAZ does have a commercial tag to mark those types of posts, which I did look for here.

A ponzi scheme is based on paying investors from their own investments or the income when other investors buy in.  That is CLEARLY not the case here with messiah.  Nobody is getting paid for anything except for the parent compang selling the product.

A pyramid scheme promises returns from the enrolment of others.  The more people you get to enroll the more profit you make.  You are also promised profits from the people those people enroll.  Supposedly.  Profits come, not from the sale of a product or service, but from the enrollment alone.  This is also clearly not the situation either.  The only benefit we get by recruiting others is the license we paid for.  They have stated that all will get a refund if their goal isn't met.  Sorry, this is NOT a pyramid.

The only point that I slightly disagree with is they have no requirement to post the goal in actual sales.  That would give their competitors information about their user count.  No business wants to disclose information like that to their competitors.  I personally would like to know but its really not relevant. They display a % bar that you can simply view the HTML and see the numeric progress (percent wise, not in actual number of sales), which is currently at 41% (up from 32% yesterday last I checked).

My only mission was to let folks know about the deal.  I have succeeded with that.  This is not, nor ever was intended to be spam.  It was intended to be information about a good deal on an application that can be used with, alongside, or in lieu of Poser.  I still think its relevant to the poser forms but the moderators have chosen otherwise.  So be it.

 

I can only suggest that in the future everyone be cautious about posting that Victoria 5 has been released or is on sale at DAZ or that a new version of UVMapper has been released or even putting links to other stores in their sigs lest they be accused of being a spammer.

From reading threads in the messiah forum, Wegg explains how to use the USB Flash drive to render with messiah on separate machines. Apparently that's OK with the Pro license.
