hi guys. i'm trying to understand copyright stuff. i'm the information is here in the forum somewhere, but i can't find it here nor in TOS. i'm wondering how we know when we're infringing on a copyright. ok, for example, christmas tree decorations...someone designed them, right? is it copyrighted? is it an infringement of copyright law to photograph it and upload it? here's one i'm working on but will most like scrap. but i just want to know for future reference. thanks guys!

I think you are pretty safe with this sort of thing tv. If photographing this sort of thing was an infringement it would be almost impossible to photograph anything other than landscapes. Press photographers wouldnt be able to shoot reportage shots as there as almost always something in them that is designed by someone. This sort of thing may be covered by a patent which covers the designer from someone else copying the design, and selling it as their own design.

The Truth is Out There

thanks guys. i was thinking along the same lines as ya'all. Kemal is still telling me he thinks it's an infringement...so i asked in copyright forum. thanks cindy for giving me that link! (and the other.) i read a couple of articles...trying to wade thru everything. i had some other questions so i posted them there. yes LP...i said almost same thing to Kemal... Ok brian...if i need legal counsel, i will call on you...get ready!!!! muuuuuuaaaaahhhh!

Well I mean I dont think you can take a photo that doenst have something that could be copyrighted in it,unless you do landsapes and nudes, lol. I think it comes down to intent,if you intend to make money off the photos or not. It comes down to the company,or individual that owns the rights to as how tough they are. For example, Funimation, that controls most of the anime thats translated here, once shut down a program that was freeware that would allow a fighting game of one of the animes they controlled. No one was making any money off of it,but they worried it would take money away from games they were releasing. Now on the other hand, theirs George Lucas, his motto is that as long as you arnt making money off of Star Wars, you can do what you want with it. He even encourages fan films. I mean its not like you took a picture of mickey mouse and tried to sell them for money or anything.

thanks, William. yeah...i see what you're saying...makes sense. cool about George Lucas!!!!! my husband was asking me if i was planning to upload this image. i said no...but i might attempt to take a pic tomorrow in better lighting. anyway, he said he wouldn't upload it because he felt it would be copyright violation. I was just looking at it as a Christmas tree ornament....never entered my head that uploading an image of an ornament could be a copyright violation. i get kinda confused about these boundaries. You guys remember that little snake ornament i uploaded in my gallery for Snakey? ya'all were telling me there was a copyright issue there (thank you) so i deleted it. well...what's the difference between this and that. this ornament is a piece of art too, right? this is a confusing subject to me. i appreciate ya'all taking the time to give me feedback!

well... the way i see it is with the snake bookmark... there was no border, it would be like taking a photo of a poster & saying it was yours, now if the poster was on a wall & there were other elements in the shot that would be different... just like if you had taken a photo of the bookmark laying on a desk with maybe some other objects... like a book... & then there was the issue of it even resembling a photo anymore... does that make sense?
